FUNDAMENTAL RIGHTS

RIGHT OF EQUALITY

Article 13 : Law inconsistent with or derogation of the fundamental rights shall to the extent of such inconsistency be void.
Article 14 : Equality Before Law.
Article 15 : Prohibition of discrimination on grounds of religion, race, caste, sex or place of birth.
Article 16 : Equality of opportunity in matters of Public Employment.
Article 17 : Abolition of Untouchability.
Articlel18 : Abolition of Titles.

RIGHT TO FREEDOM

Article 19 : Protection of certain rights regarding freedom of speech All citizens shall have the rights.

a) Freedom of Speech & Expression;
b) To assemble peaceably and without arms
c) To form associations or unions;
d) To move freely throughout the territory of India
e) To reside and settle in any part of the territory of India
f)To practice any profession or to carry on any occupation, trade or business.

Article 20 : Protection in respect of conviction for offences.
Article 21 : Protection of life and personnel liberty.
Article 21A : Right to Education.
Article 22 : Protection against arrest and detention in certain cases.

RIGHT AGAINST EXPLOITATION

Article 23 : Prohibition of traffic in human being and forced labour.
Article 24 : Prohibition of Employment of Children in factories etc.

RIGHT TO FREEDOM OF RELIGION

Article 25 : Freedom of Conscience and free profession, practice and propagation of religion.
Article 26 : Freedom to manage religious affairs.
Article 27 : Freedom as to payment of taxes for promotion of any particular religion.
Article 28 : Freedom as to attendance at religious instructions or religious worship in certain Educational institutions.

CULTURAL AND EDUCATIONAL RIGHTS

Article 29 : Protection of interest of minorities.
Article 30 : Right of minorities to establish and administer educational institutions.
Article 31 : Compulsory Aquisition of Property (44th Amendment Act 1978)
Article 31A : Saving of Laws providing for acquisition of estates etc.
Article 31 B : Validation of certain Acts and Regulations.
Article 31C : Saving of laws giving effects to certain directive principles.
Article 31 D : Saving of laws in respect of anti national activities (43rd Amendment Act 1977)

RIGHT TO CONSTITUTIONAL REMEDIES

Article 32 : Remedies for enforcement of rights conferred by this part.
Article 32A : Constitutional Validity. (43 Amendment Act 1977)
Article 33 : Power of parliaments to modify the rights conferred by this part in their application to to forces etc.
Article 34 : Restriction on rights conferred by this part while martial law is in force in any area.
Article 35  : Legislation to give effect to the provisions of this part.
Article 38 : State to secure a social order for the promotion of Welfare of the people.
Article 39 : :Certain principles of policy to be followed by the State.

Viz. “Equality between men and women about livelihood, ii) operation of economic system does not result in the concentration of wealth and means of production to the common detainment. (iii) Equal pay for equal work for both men or women (iv) Health and strength of was…..are not abused and that citizens are not forced by economic necessity to enter avocations unsuited to their age as strength (vi) that children are given opportunities and facilities to develop in a healthy manner and conditions of freedom and dignity and away from any exploitations.

Article 39A : Equal Justice to all.
Article 46 : Promotion of educational and economic interest of SC, ST and other Weaker Sections.
Article 51 Fundamental Duties

1) To abide by the constitution and respect its ideals and institutions, the national Flag and national Anthem.
2) To promote harmony and the spirit of common brotherhood amongst all people of India transcending religious. Linguistic and regional or sectional diversities, to renounce practice derogatory to the dignity of women.
3) To safeguard public property and abjure violence.
4) To strive towards excellence in all spheres of individual and collective activity so that the nation constantly rises to higher levels of endeavour and achievement.

Article 309 Recruitment and conditions of services of persons serving the Union or the State : Subject to the provisions of this constitution, Acts of the appropriate legislative may regulate the recruitment, and conditions of service of persons appointed, to public services and posts in connection with the affairs of the Union or of any State.

Exploitation : The State should not exploit nor should it take advantage of the helplessness of either the employees or the unemployed persons. The state should act as a model employer and give equal pay for equal work. It should not keep a person in temporary or ad hoc status for long, and take step to for their regularization. It also deals with matters relating to appointment, complsory retirement, creminal proceeding, exploitation, promotion, Transfer.
Article 311 : Dismisal, Removal or reduction in bank of persons employed civil capacities under unions or state
Article 323A : Administrative tribunal.
Article 375 : Courts, authorities and officers’ to continue to function to subject to the provisions of the constitution. (Hence every Govt. Employees should have a copy of constitution with him to protect his service interest.
